CONSTITUTION AND BYE LAWS
(Framed on 22nd May’ 1976)
1. INTRODUCTION
The World Buddha Foundation was formed and founded on 22nd May 1976 at Bodh
Gaya, Bihar in the presence and with the blessings of the Ven., Monks of the
Buddhist Monasteries of Burma, Srilanka, Thailand, Japan, Tibbet, Bhutan,
Bangla Desh, China, Taiwan, Korea, Mongolia, Vietnam, Nagpur, Darjeeling,
Sikkim, Nepal, Tai Bodhikham, International Meditation Centre, Chakama
Buddhist Monastery (Chittagaon) and Buddha Gaya Maha-Vihar Main Temple of Lord
Buddha.
The meeting was called by Ven. Bhikhu Dr. Dhammawansa, the head of Thai
Bodhikham Monastery and was held on 22nd May 1976 at Burmeese Buddhist
Monastery at Bodh Gaya under the chairmanship of Ven. Bhikhu Dhammawansa. In
the Meeting of Ven. Bhikhus (Monks) and devotees, present there, it was
resolved by all of them. Unanimously that a Trust be formed and founded for
the propagation of Buddha’s teaching and preaching to all over the world and
for the welfare and management of all Buddhist Monasteries Bhikhus (Monks).
Buddhist institutions, organisations, establishments, places and Monuments and
the people of Buddhist faith spread all over the world.
It was also resolved in the meeting that the said Trust be named as World
Buddha Foundation having its Head Quarters at Bodh Gaya (Bihar). The
Foundation accordingly declared formed and founded by the initial generous
donation of Dr. Harish Sankrityayan who had accepted Buddhism as his religion
and faith on 25th May 1975 and initiated in Buddhism by Ven. Bhikhu Dr.
Dhammawansa.
The Foundation was thus formed and founded on 22nd May 1976 and later on made
duly registered on 26th Sept. 1978 with the Registrar of Ranchi vide
Registration No. IV/217/78 under Indian Trusts Act 1882 with the objectives
mentioned here in after.
2. LOCATION OF ITS HEAD QUARTERS AND ITS SERVICE
JURISDICTION.
Its Registered office will be maintained and run at Bodh Gaya, Dist. Gaya,
Bihar and shall have the jurisdiction of service all over the world.
3. PREAMBLE.
It is and will remain purely a non-profitable, philanthropic, charitable,
academic, social, religious and autonomous organisation of the people of
Buddhist faith, dedicated to the cause of Buddhism, for promotion and
propagation of culture, philosophy and teachings of Lord Buddha in the world.
4. OBJECTIVES
(1). It shall be purely charitable, philanthropic, academic, cultural and
religious organisation of the people of Buddhist faith to serve. Volunteer and
help the people in distress, sufferers (of any type including natural
calamities, riots and wars), handicapped, socially, educationally and
economically, backward, sick and needy etc. without making any reservation,
demarcation of any nature in the world.
(2). It will establish undertake, maintain, open and run centers to develop
awareness in the members and the people towards the values and feeling of
other people living in any part of the world. It will also work for the
welfare and upliftment of the Members and the people of Buddhist faith who may
belong to any country.
(3). It will build, establish, undertake, maintain, open and run educational
institutions, technical institutions, hospitals, adult education centers,
dispensaries retiring centers, prayer halls, temples for the people of
Buddhist faith and homes for homeless, sufferers, socially dropped out,
deserted, unwanted children, handicapped, aged, Bhikhus, Bhikhunies and
devotees etc in the world.
(4). It will build, establish, undertake, maintain, open and run such
industrial and manufacturing units where sufferers, handicapped, deserted,
socially dropped outs, economically backward, unwanted and orphan children and
aged can work without being a burden on others. However, these units will
never run with the motive to earn profit but will run for the moral
satisfaction of these people and savings if any comes from these units the
same will go to the Foundation fund for extension of services further.
(5). It will do and take-up such work, programmes or to convene meetings,
seminars, conferences etc by which peace and awareness in the world can be
brought and maintained.
(6). It will organize and run programmes which will inculcate the habit of
restraint, adjustment, peaceful co-existence living, tolerance, non-violence,
brotherhood feelings among the Members and the people of the world.
(7). It will train and prepare the devotees and volunteers so that they could
go in the vast field of the world to make the people acquainted with the
teachings, philosophy and the way of living of Lord Buddha.
(8). It will seek and accept donations, grants, offerings, voluntary services
of the devotees Members, subscription contribution and may seek and negotiate
to get loan from the financial institutions, banks, individuals and deal with
the same for the objectives and programmes of the Foundation.
(9). It will invest, own, posses, dispose off, transfer, enter into agreement,
contract and otherwise deal with the regular business subject matter, funds,
resources, assets of the Foundation in such manner as the Board of Trustees
will deem fit and proper in running and managing the affairs of the
Foundation.
(10). It will undertake and organize other programmes supplementary to the
objectives of the Foundation or as decided by the Board of Trustees.
(11). It will constitute, observe and follow its own Constitution and Bye-laws
framed or to be framed by the Board of Trustees time to time for managing and
executing its policy, programme and administration for smooth running and
functioning of all the establishments and units of the Foundation.
(12). Where constitution and Bye-laws of the Foundation will be found
exhausted the Indian Trust’s Act-1882 will be referred for any legal and
practical guidance or the opinion of the District Judge of Gaya or Ranchi may
be seeked. .
5. THE DEFINITION OF SOME WORDS, REPEATEDLY USED IN
THE BYE-LAWS.
In this text of constitution and Bye-laws of the World Buddha Foundation,
unless there is anything repugnant to the subject or context: -
(a). Foundation or organisation means World Buddha Foundation.
(b). Board means Board of Trustees of the Foundation.
(c). President means President of the Foundation.
(d). Author or Founder means the Founder who created and founded the Trust of
World Buddha Foundation.
(e). Act means the Indian Trusts Act-1882
(f). Constitution and Bye-laws means the constitution and Bye-laws of the
Foundation which is framed or to be framed or amended by the Board of Trustees
of the Foundation.
(g). Trustees means the person whom the Founder or his Nominee or remaining
Trustees unanimously offered the Trusteeship of the Foundation to manage,
look-after the business and administration of the Foundation according to the
Indian Trust’s Act 1882 (Sec.3) and as per the instrument of Trust Deed of the
Foundation. Other words are sell – explanatory and well defined where they
have been used.
6. SPECIAL INSTRUCTION ABOUT ADMINISTRATION OF THE
FOUNDATION:-
Internal administration of the Foundation and its units , establishments will
be governed by the Constitution and Bye-laws of the Foundation framed or to be
framed or amended by the Board of Trustees from time to time as per need.
Being an autonomous and Buddhist religious organisation formed to execute
specific purpose and carry out the desire of the Founder and spirit of the
Foundation, it will make its own rules and regulations framed or to be framed
by the Board of Trustees. Further, the rules and regulations have been framed
or to be framed keeping in view the concept and philosophy of Buddhism and for
economical, smooth and efficient running and management of the Foundation and
its units at all times. While framing the bye-laws, all aspects of religious,
legal, social and financial implications have been considered and observed so
that, persons actively attached or associated to the organisation may develop
a sense of discipline, devotion and satisfaction of purposeful service in the
cause of Buddhism. However, it should be clearly explained and make understand
to all the Members who join the Foundation about its nature, so that, they
should join the Foundation with a sense of dedication and selfless service.
The Foundation should not be deemed by any Member person as a source of
pleasure, employment, income or business. Each programme and project will have
specific rules and regulations under this bye-laws framed or to be framed by
the Board of Trustees for smooth management of each programme and project.
Therefore no Trustee or Member of the Foundation will make any appointment of
any staff in the Foundation for any office or job on wages, salary or
emoluments because this will be contrary to the contract between the Founder
and the Trustees of the Foundation. It shall also be against the concept and
philosophy of the religion of Buddhism to take work from a slave or a person
as servant for the benefit of anybody or even for the organisation. In
Foundation all are equal and no one is servant or master employee or employer.
Therefore the Rules and Regulations of the Foundation may or may not tally
with the Rule and Regulations of any other similar organisation, State or
Central Govt. organisation. Where the Rules have not been written or mentioned
in the Constitution, and bye-laws of the Foundation the prevalent rules of the
Indian Trusts Act 1882 will be applicable.
Further, because the Foundation has been setup to serve the people of Buddhist
Community for their upliftment and welfare, on many occasions and for some
specific projects or programmes the Foundation may need the help or services
of such experts or skilled persons who may not be the Members of the
Foundation, but they wish to help the Foundation by their expertise against
some fee or charges, such persons may be engaged against payment for such
period till our members become able to handle that type of job and
responsibility or for such period till particular project is completed or
over. In all cases it should be kept in mind that taking work from a person
against wages will deem to be against the very philosophy and concept of
Buddhism. It is like making a person slave in disguise.
7. THE TRUSTEES
The Legal Identity of a Trustee: - The person whom the Founder of the World
Buddha Foundation had offered the Trusteeship of the Foundation at the time of
its formation and also later on after its formation, the Trusteeship of the
Foundation given by the Founder to any other person or persons during his
(Founder’s) life time, or whom the Trusteeship has been offered by the Nominee
of the Founder or by the remaining Trustees unanimously shall only be the
Trustees of the Foundation. There will be SEVEN TRUSTEES in all at all times
and which must be maintained always. It will be obligatory and compulsory to
have automatically on vacancy, due to death of the Founder, one nominee of the
Founder as a Trustee be nominated, appointed and included in the Board of
Trustees of the World Buddha Foundation. In case of death, termination,
retirement or resignation of any Trustee other than the Founder or his Nominee
(Trustee) the new Trustee will be introduced and nominated by the Founder in
his life time and after the death of the Founder, his Nominee will introduce
and appoint a new Trustee to the Foundation with the majority consent of the
remaining Trustees. The Founder, so long alive, shall be the President of the
Foundation and shall preside over all the meetings of the board of the
Trustees with the right of casting Vote.
After the death of the Founder, the Nominee will call the Board’s meeting to
elect President of the Board of Trustees by majority votes and he shall
preside over all the Boards meting. Nominee shall have power to appoint a
Trustee as his Nominee in the Board with all the powers which he had enjoyed
in his life time sitting in the Board of Trustees. So long the Founder is
alive, he may withdraw the Trusteeship from any Trustee (Person) given earlier
to him and there after such person will not remain a Trustee of the
Foundation. After the death of the Founder, Trusteeship from a person may be
withdrawn by the Board as per provision of the constitution and Bye-laws of
the Foundation.
8. RE-IMBURSEMENT TO TRUSTEES
No Trustee shall be paid any salary or remuneration for doing or conducting
any work of the Foundation. However, if a Trustee spends any amount from his
own pocket in doing any work or make purchase of any item for the Foundation
or for its any unit that amount will be reimbursed to him. If a Trustee
exclusively undertake any tour for the Foundation work and submits his bill of
expenses, he will be paid for his all actual expenses in full. In case a
Trustee is given charge of
executing any programme or asked to hold any office regularly and if he does
so, he may be given some traveling allowance to meet his conveyance expenses
to attend office or to execute the programme. The amount of such allowance
will be decided by the Board of Trustees after considering the nature of
responsibility and involvement of expected expenditure related to the working
and traveling.
9. THE DUTIES, POWERS AND THEIR LIABILITIES
In addition to the duties mentioned in the Indian Trusts Act 1882 and in the
Trust deed of the Foundation, the Trustees will Co-operate among themselves
with a sense of dedication, selfless service towards achieving the desire of
the Founder and objectives of the Foundation. They all will work jointly. The
Trustees individually shall not be responsible to pay for any loss or debt of
the Foundation from their own pockets if such loss and debt were not made or
created by their own fault. (See I.T.A. 1882 Sec. 15).
All the Trustees of the Foundation jointly will form the Board of Trustees,
capable to do and execute all the business, works and programmes of the
Foundation.
A Trustee may sue on behalf of the Board of Trustees, who shall be capable
competent and empowered to bring a suit in the Court of law against any body
or a group of person to protect the title and interest of the Foundation or
its property and also to protect the programmes, projects, units and interest
of the beneficiaries of the Foundation and in cases brought against the Trust
by an outsider all the Trustees will defend jointly or as permitted or decided
by a competent court of law to represent the Foundation in particular case
according to C.P.C of India and Indian Trusts Act 1882.
10. CEASURE OF THE TRUSTEESHIP
(a). When a Trustee submits his resignation to the Founder or Board of
Trustees and the same is accepted, he shall ceased to be a Trustee.
(b). When a Trustee does such activity which the Founder or his Nominee or
Board of Trustees consider undesirable and which may defame the Foundation,
the Founder or his Nominee or Board of Trustees will withdraw the Trusteeship
from that person, and soon after such decision, the said person will no more
be a Trustee of the Foundation. Withdrawal of Trusteeship from a Trustee must
be discussed and resolved as such in the Board of Trustees meeting and
proceeding should be recorded properly in the proceeding Book of the
Foundation.

12. THE MEMBERS:
The Identity of a Member and Membership of the Foundation:
Being an autonomous religious Trust (The Foundation) formed under India
Trust’s Act 1882, nobody can claim as a matter of right for its membership.
However, the Founder or the Board of Trustees may offer its membership to any
dedicated person who will be a Buddhist by faith or be an admirer of Buddhist
philosophy and Buddhist way of living and shall be desirous to volunteer
his/her co-operation to the Trustees to achieve the objectives of the
Foundation. Further, any person desirous to volunteer his/her services to the
Foundation and he/she may or may not be a Buddhist may also approach the
President for the membership of the Foundation and on finding good in all
respect by the Board of Trustees, may be given its membership to him/her by
the Board of Trustees.
There will be various categories of Membership, the Board will decide under
which category a Membership will be given to a person.
13. CLASSIFICATION OF MEMBERSHIP:
(i). PATRONS – Those who take keen interest in the activities and programmes
of the Foundation and agreed to volunteer their services to guide and advise
the Trustees as and when it is sought or deemed necessary and to whom the
Founder or the Board of Trustees requested for the Membership to patronize the
Foundation and who accepted the request in this matter, will be the Patrons of
the Foundation. A Patron may or may not be a Buddhist by faith or religion.
(ii). ACTIVE MEMBERS – Those who are Buddhist by faith and religion and will
take active part in all the programmes of the Foundation and to whom such
membership of the Foundation has been offered by the Founder/Nominee and the
same is approved by the Board of Trustees, such persons will be known as
active members of the Foundation. They will assist and help the Trustees in
smooth running efficient management of the Foundation, its units
establishments and also to help in raising funds for the Foundation by
accepted code and means.
(iii). Associate Members - The persons who are admirer of Buddhism and believe
in humanity, casteless society and wish to assist and co-operate the
Foundation in executing its programme and project but can not give much time
and may or may not be a Buddhist and to whom the Board of Trustees gives such
membership for his/her assistance in achieving the objectives of the
Foundation, will be known as Associate Members of the Foundation.
(iv). Well-Wisher Members – A person who is not a Buddhist by religion or
faith but finds the Philosophy of Buddhism close to his/her own religion and
willing to serve the people of the world for their welfare, the Board of
Trustees may seek co-operation and help of such person without offering
him/her the regular membership of the Foundation by registering his/her name
in its Membership book as Well-Wisher Member of the Foundation.
Note: No Patron or Member of any category, will be paid any salary,
emoluments, wages etc for their services.
14. DUTIES, POWERS AND LIABILITIES OF THE MEMBERS:
(a). Patrons – Whenever Patrons desire, they may draw the attention of the
President or the Board of Trustees with a view to improve the quality/standard
or the activities/programmes of the Foundation. Their advice and suggestions
will be given due regards and the Board of Trustees will look into the matter
immediately. In all the functions, they will be special invitees.
(b). Active Members - Inspite of the fact that the Executive powers are vested
in the Board of Trustees, even then, the Active members are expected to be
responsible for smooth running and management of the Foundation. They will
help and Co-operate each other to achieve the objectives. No member or Patron
will be liable to meet any loss or debt of the Foundation if such loss or debt
is not created by his own fault or misdoing.
(c) Associate Members- These Members will help the Trustees of the Foundation
by extending their co-operation in achieving the objective of the Foundation
as and when it will be needed.
(d) Well-Wishers Members- Well Wishers are those who support the objective of
the Foundation. They may or may not be a Buddhist. They will help the Board of
Trustees in executing its policy and programme at all level.
Note: Paying any amount under any head to a Member to meet expenses in
executing the programme will not be deemed as wages or emoluments.
15. FEES FOR MEMBERSHIP:
There shall be a membership fee for each category of Membership.
Following is the present schedule of Membership fee which may be increased. If
so desired and decided by the Board of Trustees: -
1. Patrons – No Fee
2. Active Member - Rs 50.00 P.M
3. Associate Members – Rs 10.00 P.M
4. Well Wisher Member – Rs. 5.00 P.M
There will be an enrollment fee of Rs 50.00 only for all category of
Membership but not for the Patrons.
16. CEASURE (FORFEITURE) OF THE MEMBERSHIP
(a) When a Member submits his resignation to the President or Secretary of the
Foundation and the same is accepted by the Board of Trustees he shall ceases
to be a Member of the Foundation.
(b) When a Member stops paying Membership fee continuously for 3 (three)
months his/her Membership will automatically stand terminated.
(c) When a Member does such activity which the Board of Trustees of the
Foundation considers undesirable and which may defame the Foundation the Board
of Trustees will withdraw the Membership from that person and since then the
person will no more be a Member of the Foundation.
(d) When it is found to the full satisfaction of the Board of Trustees that a
Member looses interest in the working of the Foundation, his Membership will
be withdrawn and he shall no more be a member of the Foundation since that
date.
17. LIST OF THE MEMBERS
For the list of Members, the Foundation will maintain a register for it
separately. The Register will be maintained and available at Head office of
the Foundation
18. THE ADMINISTRATIVE SET UP OF THE FOUNDATION AND
ITS PROGRAMMES
(a) The Board of Trustees – is and shall remain be the Supreme body of the
Foundation having full powers of Administration and Managements of the
Foundation and all its units and establishments taking decision or doing
execution, promotion, executing, contract, agreement, purchase, disposal,
seeking and accepting loans, giving out the Foundation money on loan,
accepting grants, presents, voluntary services. Power to own and posses assets
and properties related to the Foundation. The Board of the Trustees with all
Trustees jointly will only have the powers to frame or to amend the bye-laws
of Foundation for its smooth management and easy working for ever.
(b) Central Council of the Foundation – The Board of Trustees of World Buddha
Foundation will constitute central council including selected Member of the
Foundation. The council will have a separate Rules. This council will work
under the Board of Trustees and will assist the Board in executing and
administrating its establishment and programme, spread all over the world.
The Board of Trustees will constitute a central Executive committee in the
Central Council to look after the business and working of all the units and
establishment of the Foundation. The Rules and Regulation of this committee
will be written separately.
(c) Regional Councils of the Foundation – The Board of Trustees of the
Foundation will constitute Regional Councils with the members of Particular
region.
(d) Regional Executive Committee – The Board of Trustees of the Foundation
will constitute Regional Executive Committees in Regional Councils every year
for particular region by nominating Members and office bearers for each such
committees, to look after the establishments units, programmes etc of the
Foundation situated or functioning in that region.
The Rules and Regulations for Regional Councils and Executive Committees are
written separately with this Bye-laws.
19. NOMINATIONS FOR THE OFFICE BEARERS OF THE
FOUNDATION:-
Though the Board of Trustees hold all the powers and are fully competent to
execute and manage all the affairs of the Foundation and its programmes and
projects but for routine office works it is needed that the Trustees should
hold offices of various responsibility in the Foundation to ease the official
working and administrative work of the Foundation will nominate and designate
the particular Trustees for particular office and responsibility for
particular job in the Foundation Registered/Central office, and Regional
offices.
Accordingly, the Trustees will hold the following Offices in the Board of
Trustees.
1. President
2. Vice-President
3. Secretary
4. Treasurer
5. Joint Secretary (Programme)
6. Joint Secretary (Establishment)
7. Joint Secretary (Finance)
20. THE DURATION (TENURE) OF THE OFFICES OF NOMINATED
PERSONS OF THE BOARD OF TRUSTEES:
The duration of the office bearers would be of three years commencing from
Budha Purnima of 1976. In case one drops before the expiry of the schedule
period of the Office the President will nominate other Trustees in-charge to
that office.
21. THE OFFICE BEARERS, THEIR DUTIES AND POWERS:
I. President
Being the Author of the Foundation, the Founder, so long alive, shall be the
President of the Foundation. After the death of the Author, the Trustees will
decide/select/nominate the President. The President will be responsible for
the following:-
(a) The President by virtue of his office, shall be the head of the Foundation
and shall exercise his power on all establishments, units, meetings,
proceeding etc. and also keep supervision and control on the working and
activities of the Foundation.
(b) He shall call and preside over all the meetings of the Foundation.
(c) He shall appoint auditors to audit the accounts of all the offices of the
Foundation and its unit.
(d) He shall assign and allot the work and responsibility to the Trustees and
Members of the Foundation for all the offices and institutions of the
Foundation.
(e) He shall call the Board’s Meetings every month to assess, review and to
discuss over the business, achievement and programmes, of the Foundation and
for future planning, working and programme for all the units of the
Foundation.
(f) He shall hold, over-all responsibility for the smooth and efficient
management of the Foundation.
(g) He shall keep reserve fund and other working funds in State Bank of India
or in any scheduled Bank of India under the Joint signature of any two members
of the Board of Trustees from the following:-
1. President
2. Vice-President
3. Secretary
4. Treasurer, or as decided by the Board of Trustees to authorize 2 members to
open and operate Bank accounts for the Reserve Fund and all other working
funds of the Foundation.
(h). He shall have powers to represent the Foundation on behalf of Board of
Trustees, can execute any agreement, assign any power to any member, do any
contract in any matter related to Foundation.
II. Vice-President
(a) As per Bye-laws of the Foundation a Trustees so appointed and nominated by
the President will be the Vice-president of the Foundation.
(b) He shall be responsible for executing the normal business of the
Foundation and its units in a smooth and efficient manner.
(c) He shall be responsible for correct and up to date maintenance of all
records pertaining to the Foundations and its unit and shall conduct all the
routine work of its Head Quarters or as desired by the President.
(d) He shall have power to enter into any contracts and agreement on behalf of
the Board of Trustees of the Foundation or in the matters, resolved in the
Board’s meeting.
(e) He shall keep and transact all the funds including the reserve fund of the
Foundation to the best of his ability and towards achieving the objectives of
the Foundation and as per resolution of the Board.
(f) He shall open and operate the bank’s accounts for all the units,
programmes, project, schools and institutions of the Foundation jointly with
other Trustee, as per resolution of the Board of Trustees.
(g) He shall be the administrator and controller of all the programmes,
projects, institutions and schools run by the Foundation and shall work as per
resolution of the Board of Trustees.
(h) He shall submit all the reports of business activity and accounts duly
checked by the authorized auditors, appointed by the President for the purpose
before the Board of Trustees.
(i) He shall be the overall coordinator of all the activities of the
Foundation.
(j) All the expenses incurred by him/her towards executing the policy
programmes and the business of the Foundation will be reimbursed to him.
III. Secretary
(a) The Board of Trustees will decide and select one of the Trustees to work
as Secretary to the Board of the Trustees and work to assist the Board and the
President in achieving the objectives of the Foundation.
(b) He will do all such work which will be resolved by the Board of Trustees
and shall be responsible to the President and the Board of The Trustees of the
Foundation.
(c) He shall have power to represent the Foundation in his/her official
capacity.
IV. Joint Secretary
Where the Board will deem necessary, the joint Secretary will be nominated
from the Trustees of the Foundation and shall work for the Foundation’s office
to look after the affairs managements and execution of the programmes, unit or
units of the Foundation along with other Trustees. There may be more than one
Joint secretary in the Foundation and will work as per resolution of the
Board.
V. Treasurer
The Treasurer will be responsible for maintaining all the records related to
money matters of the Foundation and its Units. The Board of Trustees will
nominate one of its Trustees to hold the office of the Treasurer. He will be
responsible to the Board of Trustees and particularly to the President.
VI. ADMINISTRATIVE OFFICERS AND DIRECTORS
The Board of Trustees, if needed will nominate an administrative
Officer/Director from the Trustees or the Active members of the Foundation to
look after the administrative work of the Foundation and its programmes,
units. He shall work directly under the Secretary and shall be responsible to
him. He will see the routine office work of the Foundation and its units are
done properly and shall do such other work assigned to him by the Secretary
and Board of Trustees.
22. THE PROGRAMMES OF THE FOUNDATION
The Foundation will open and run various programmes, educational institution,
Technical & Professional institutions and establishment in the Country and
abroad to promote the cause of knowledge, wisdom, skill Buddhism and awareness
by spreading education. Following are the main programmes established or to be
established and run by the Foundation. Each such programme will have specific
rules and regulation to execute and regulate the working of the particular
programme by which the person attached to the programme, will be guided. Such
special rules will be framed by the Board of Trustees. There will be senior
Trustees or Member to be nominated “in-Charge” to such programmes and hold its
office as Executive secretary of each programme. The Board may nominate a
member as chairman for a unit or establishment or group of establishments, as
the case may be or decided by the Board of Trustees. The other Members will
work under him. In no case, any outsider or non member of the Foundation will
be asked to help or work for any type of work in the Foundation office against
salary or wages.
(a) FUND RAISING PROGRAMME
As no programme can be executed effectively without proper fund, therefore the
Foundation will have this wing to raise the fund for the Foundation by
accepted code and norms. The programme will be headed and executed by the
Secretary of the Programme. A specific Rules and Regulation will be framed by
the Board for its smooth functioning.
(b) AUDIO VISUAL TEACHING PROGRAMME
Each and every student need to be taught through audio-visual teaching aids as
these methods of teaching is very effective to explain the subject matter
easily. Hence, the Foundation will maintain wing of manufacturing audio-video
teaching materials for the young’s. The Secretary will be the head of the
programme.
(c) CHILD GUIDANCE PROGRAMME
The Foundation will maintain a programme of child Guidance for the young
students and will offer service to the parents for their wards in selection of
specialized profession and career. The programme will be headed by the
Secretary of the programme and shall have specific rules and regulation.
(d). ACHIEVEMENTS AND SERVICES APPRECIATION PROGRAMME
To encourage the successful and dedicated persons or institutions for doing
good things to the society, the Foundation will maintain a wing in this
matter. The Foundation will give certificates and cash awards to such persons
and institutions. The Secretary and its team of members will prepare the
programme and will get it approved by the Board of Trustees. A separate Rules
& Regulations will be framed by the Board for its smooth functioning.
(e). SERVICES EXTENSION PROGRAMME
The Foundation will extend its experiences and expertisation of managing
schools, Educational institutions etc to the others and to do so, a wing of
experts will be maintained in the Foundation. A separate rules and regulations
for this programme will be framed by the Board for its smooth functioning.
(f). SCHOLARSHIP PROGRAMME
The Foundation will have a programme to encourage and appreciate the talented
students and also to help the poor students of the community and other
community in continuing their studies by awarding scholarship. The Foundation
will also give financial assistance to the youngsters who are excellent in
performance and belonging to Buddhist community or economically backward
family. The Secretary of the programme will be responsible to get the
Programme executed. The Foundation will do such other work under this
programme by which talented students could be encouraged and awarded. Rules &
Regulations for this Programme will be framed by the Board for its smooth
functioning.
(g). HEALTH EDUCATION PROGRAMME
The Foundation will develop and establish such institutions where education to
maintain health and method of treating sick could be imparted. The
institutions will be like Medical Colleges, Nursing Colleges where systems of
treating sick could be taught either through the advance Allopathic medicines
system or Ayurvedic system of medicines or any other similar method follow and
as decided by the Board of Trustees.
To establish & run Hospitals, dispensaries etc will also come under this
programme. A separate Rules will be framed by The Board for the smooth
functioning.
(h). RELIGIOUS AND SPIRITUALS PROGRAMMES
The Foundation will organize such programmes by which orthodoxic and
traditional Social concept will be eradicated from the Society, so that a
fresh and enlightened society could be emerged for the development of entire
human race. A rule to run the programme smoothly will be framed by he Board.
(i). EDUCATIONAL PROGRAMME
To educate the youngsters from lower level to higher level of learning for
their development and livelihood career. A separate rules will be framed by
the Board for this Programme.
23. MEETINGS
The Board of Trustees will meet every month or earlier needed by the Trustees
to discuss various affairs, working and business of the Foundation for
efficient management of the Foundation.
The meeting will be deemed in order with 51% attendance of the Trustees. To
adopt a resolution for particular programme in the meeting at least 4 (Four)
Trustees must be present. In case of controversy or difference in opinion to
pass a resolution, the Founder or his Nominee may pass ruling over such
matters which will be valid and effective & binding. No Resolution will be
deemed proper and valid if the same has not been passed by at least 4 (four)
Trustees jointly. In the matter of financial involvement and disputed matters
the Majority votes will be required to pass a resolution otherwise it will not
be a valid resolution.
24. PROFORMAS FOR STATIONERY AND RECORDS
The Foundation will prepare and prescribe proformas, designs etc for all its
stationery and records. No institution or unit will be allowed to prepare or
design any proforma other than approved by the Board of Trustees for their
use. The proformas and designs are shown in the
appendix of the Bye-laws. All the stationeries, registers, files, forms,
letter heads, envelope etc will be prepared and printed by the Foundation for
all the units, programmes & projects and the same will be distributed to all
units by the Foundation for their use.
25. PURCHASES
All purchases, whether meant for a programme or a unit, will only be made by
the Secretary of the Foundation. No officer or member will have power to buy
any item from the market unless otherwise asked by the proper Authority. The
required items will be supplied to the units by the Central Store of the
Foundation. However, the Secretary may give power to other members to buy
simple things from the local market in cases of urgency.
26. ALLOTMENT OF RESPONSIBILITIES AND POSTINGS OF THE
MEMBERS
The Author of the Foundation strictly believe in the philosophy of lord
Buddha-“Atta Hee Attano Natho” and wish that no person should be appointed in
the Foundation or any of its units, programme or project as ‘Servant’ to work
in the Foundation.
According to the Founder it is against the very Concept of Buddhism and the
feeling of Lord Buddha to employ a man on payment or wages for doing a job for
the benefit of an organization or any person by making them a slave/servant in
disguise.
However, as stated above, where skill person is required or an expert is
required the Board may seek the help and co-operation of the person and pay
charges or fee as the case may be.
Hence it will be strictly prohibited to employ a person in the Foundation
against wages, salary or remuneration for the labour or services done by
him/her.
The Foundation will request only its Trustees and Members to help and
volunteer themselves to assist the Foundation in executing its project and
programmes to achieve its objective & for the welfare of the people of the
Buddhist community and other living beings.
Further, in some places or in some circumstances where Trustees or Members of
the Foundation, the skilled and technical person will be asked to get the work
done on a contract basis and not on the wages basis.
27. Member wishes to stay in the campus of the
Foundation anywhere in the country.
A Member will get free lodging, fooding, clothing, beds, toilet items etc. and
pocket money according to the need of the situation, assignment of
responsibility, and circumstances of the place. The Board of Trustee will
decide each case on its own merit for payment of pocket money and other
allowances or facility. When a member is assigned responsibility to undertake
particular duty or responsibility at such places, where residential
accommodation and common mess are not available the Foundation will pay for
fooding and lodging etc. plus pocket money to such Members as per decision of
the Board of Trustees. Each case will be decided individually to respect the
sentiment and devotion of each Member. Such facilities or amount of Pocket
Money should not be treated as emolument or wage for the work of a Member, nor
the amount of pocket money should be valued or compared with the quantum of
work.
28. MEMBERS WELFARE PROGRAMME
A fund will be created and maintained separately by the Foundation with its
own resources for the welfare and for extending financial, medical and other
assistance in old age of the Members.
Though the Foundation will establish and run homes for aged (old age) Members
with family like facilities but if any old aged Member would like to stay with
his / her family Members he/ she may do so and the Foundation will extend its
assistance as per decision of the Board of Trustees or Executive Committee
specially formed for Members Welfare Programme.
Separate Rules and regulation will be framed for this programme by the Board
of Trustees with the consent of the Members of the Foundation.
A separate Executive Committee by nominating or selecting Members by the Board
will be formed and constituted to look after the working of this programme.
Rules and Regulation will be farmed separately by the Board of Trustees to
manage the Working of this programme effectively. A separate bank account will
be maintained for this programme which shall be operated a separate Executive
committee of the programme.
29. RULES AND REGULATIONS FOR HIGHER EDUCATIONAL
UNITS
The Board will frame Rules and Regulation for higher and Technical educational
units according to the Rules of statutory bodies.
Hence, separate rules will be formed for each such institution.
Certified to be the True copy of the Resolution making Constitution & Bye-laws
of World Budha Foundation by the Board of Trustees in the meeting held on
22/05/1976 at Bodh Gaya, Bihar under the Chairmanship of Venerable Bhikhu Dr.
Dhammawansa Mahathera.
